28 U.S.C. § 144 provides for disqualification of a judge
based on personal bias or prejudice and upon an affidavit of the litigant and a certificate of counsel. The statute
reads:
Whenever a party to any proceeding in a district court makes and files a timely
and sufficient affidavit that the judge before whom the matter is pending has a personal bias or prejudice either against
him or in favor of any adverse party, such judge shall proceed no further therein, but another judge shall be assigned to
hear such proceeding.
The affidavit shall state the facts and the reasons for the belief that
bias or prejudice exists, and shall be filed not less than ten days before the beginning of the term at which the proceeding
is to be heard, or good cause shall be shown for failure to file it within such time. A party be shown for failure to
file it within such time. A party may file only one such affidavit in any case. It shall be accompanied by a certificate
of counsel of record stating that it is made in good faith.

Plaintiff's Demonstrated Costs are the result of Forced Commercial Transactions initiated by Defendants' crimes against Plaintiff's
family which are known to This Court starting 07/20/2009 and intensified by This Court's Discriminatory Docket Manipulation
in favor of organized crime Defendants and should be paid by Defendant Timothy E. Possenti who has been shown to This Court
in Plaintiff's 09/10/09 Petition In Forma Pauperis; Plaintiff's 09/10/09 Complaint; Plaintiff's 10/16/09 Amended Complaint;
Plaintiff's 10/26/09 Second Emergency Amended Complaint (counter-intuitively stricken by USDC PaED but a publicly posted verified
truthful record held perpetually in Court Reform administrative solutions tool, U.S. Citizens Controlled Public Docket Database);
Plaintiff's 11/09/09 Answers with Objections for Coerced Withdrawal Under Duress, falsely recorded into USDC PaED's discriminatorily
controlled docket but accurately recorded and held perpetually in Child Slaughter U.S. Economy Fraud Court Reform administrative
solutions tool, prototype, U.S. Citizens Controlled Public Docket Database; and in Plaintiff's 02/04/2010 fifth request

USDC for the Eastern District of Pennsylvania Clerk's office. How in the world a United States District Court Judge
had time to read 115 pages and enter a qualified fair order on the same day it was filed - and how order was entered next
day 2/05/2010, somehow making Plaintiff responsible for service of summons that this Court ordered U.S. Marshal's office to
service summons on Defendants on October 16, 2009 which turned out to be a bogus summons returned with false proof of service
comment - brazenly scanned and remaining to this date in This Court's controlled prejudicial docket report; is beyond
all reason. Unless there is exactly what USDC Pa Docket Reports 209cv04199-MSG and 209cv05448-MSG show - a predisposed
prejudice which seeks to block all fair and accurate adjudication of redress for CPS Corruption in Government Victim Plaintiff

PLAINTIFF'S 02/12/2010 AFFIDAVIT THIS COURT'S DISCRIMINATORY DOCKET MANIPULATION IN FAVOR OF
CORRUPTION FRAUD DEFENDANTS COMMENT: Plaintiff pleaded time and time again through filings with This Court,
emails and Letter Notices to United States Attorney General For the Eastern District Michael Levy's office for her 2004

for the sake of truth in public record to respectfully suggested, responsibly recorded, US Economy and Court Reform and
CPS Corruption Administrative Solutions Tool, Prototype Development of US Citizens Controlled Public Incident Report Docket
Database.
Plaintiff's 2/4/2010 filing is 115 pages with eleven undisputed and undisputable factual
proof exhibits, are swiftly summarily denied same day of filing. Judge's 2/4/2010 order claims a months old "motion
to dismiss" "plaintiff's timely filed answers" is being considered and falsely claims Plaintiff has not duly
served via certificate of service each and every party in this case according to the parties entry of appearance, including
Barbara Deeley, Philadelphia Sheriff's Executive Assistant who contacted Roxanne Grinage by email and instructed Plaintiff
to direct service to 3 Philadelphia Sheriff's Office Defendants to Barbara Deeley. Plaintiff's costs have since
grown to $5912.00 allowing for Philadelphia Adoption Court Petitions for Court Order to Reveal Sealed Family Court records
"Intent of Adoption" or "Petition for Adoption" suspected to be impending threat posed by Timothy E.
Possenti's long history of fraud crimes.
Plaintiff is not responsible but is nevertheless
further victimized by Fern Brown Caplan's and Timothy E. Possenti's bogus summons issued by This Court strangely not evaded
by answering non-malicious Defendant Judge Lisette Shirdan Harris even after This Court's bogus summons indicates service
remark, "Spoke to Judge's clerk and no forwarding address is available." This Court's docket manipulation
claims to have "served plaintiff's exhibits hard copy but only 2 pages of Plaintiff's 115 page Filing is scanned
into This Court's discriminatorily censored docket report and by Honorable Mitchell S. Goldberg, This Court has incredibly
transferred responsibility for This Court's bogus summons upon Plaintiff in a decisive prejudicial falsification of a
public record and confirming condemnation of any hope for fair and accurate redress by this Court. Plaintiff did
in fact provide Certificate of Service certifying electronic service to all six defendants on 2/4/2010.

Plaintiff's Affidavit itemizes USDC Eastern Pennsylvania Docket Discrimination in 209cv04119-MSG and 209cv05448-BMS which
confirms condemnation of any chance whatsoever of CPS Corruption in Government Victim Plaintiff attaining access to redress
of grievances in This United States Eastern District Court for the Eastern District of Pennsylvania.

Itemization of This Court's controlled prejudicial docket manipulation reveals that the prejudice lies not in the individual
USDC Judge but in this United States District Court for the Eastern District of Pennsylvania holding fast to This Court's
refusal to correct administrative errors which preclude any assigned Judge in the Eastern District of Pennsylvania from knowing
the accurate cause nature and merits of Plaintiff's injuries and forced commerce complaints about Timothy E. Possenti, Esquire
PC and Fern Brown Caplan, Esquire.

Plaintiff's suffering and Plaintiff's family's suffering and Plaintiff's costs are intensified by This Court's counter intuitive
docket discrimination in favor of This Court's commercial litigation colleagues practicing in the very same jurisdiction Plaintiff
proves Defendant's felony crimes and hailing from the very same counties and boroughs where United States District Court Judges
for the Eastern District of Pennsylvania came up through the ranks of impressive "super lawyer" careers which afforded
many opportunities for professional, community and fraternal camaraderie to evolve between This Court's criminally behaving
colleagues and this Court's Clerk of Court's office.

The "orders" coming out of USDC PaED are the uninformed, unqualified product of USDC Eastern Pennsylvania's Clerk
of Court's office (Michael E. Kunz) censored, mutilated, counter-intuitive USDC PaED Clerk of Court controlled docket discrimination
reflected in Docket Report U.S.D.C. PaEd 209cv04119-MSG and deliberately prejudicially "statistically closed" Docket
Report 209cv05448-BMS.

This Court's refusal to own responsibility for flagrant administrative errors and deliberate service of a bogus summons discriminates
against Roxanne Grinage's family, HireLyrics Administrative Services community development enterprise and Philadelphia community
families.

This Court's refusal to own responsibility for flagrant administrative errors and deliberate service of a bogus summons have
intensified the injuries, costs, damages and growing contingent liabilities posed to Plaintiff's grandchildren, Plaintiff's
finances and Plaintiff's Philadelphia community.
7. This Court's
refusal to own responsibility for flagrant administrative errors and deliberate bogus summons has fueled a measurable U.S.
Economy Fraud detrimental work ethic synergy whereby criminally behaving court-positioned assailants Timothy E. Possenti and
Fern Brown Caplan's wealthy politically powerful families unfairly siphon and defraud federal and state funding sources smug
in their knowledge that no matter what Possenti/Caplan are protected by This United States District Court For The Eastern
District of Pennsylvania.

Timothy E. Possenti, Esquire hails from a large wealthy politically powerful law-practicing family of commercial litigation
township local government hospital philanthropy; neighborhood Bar and Restaurant; and at least one New York law firm discovered
so far.

Timothy E. Possenti, Esquire and Fern Brown Caplan trade in real estate; serve on boards of directors having influence
and a fraternal camaraderie (Wiedner University Law School) with just about any USDC Judge in the Eastern District of Pennsylvania
who came up through the ranks of Bucks, Montgomery, Delaware County or the surrounding Pennsylvania Tri-State area which includes
New York.

Gloria Allred is an extremely respected politically powerful and wealthy attorney who states in a CBS 48 hour interview that
Fern Brown Caplan is her best friend for more than thirty years having formed bonds in high school here in Philadelphia.
Even though Gloria Allred's law firm is in California, Fern Brown Caplan hails from Montgomery County and has at her disposal
much more lawyer-fraternal camaraderie wealth and political power than do the middle class and working poor Philadelphia Community
families who Fern Brown Caplan inflicts financially motivated Philadelphia Family Court-Ordered Child Abuse upon daily in
the very same location where This Court's bogus summons claims Defendant cannot be found to be served with Honorable Mitchell
S. Goldberg's October 16, 2009 order to serve the Defendants with Summons to answers plaintiff's 09/10/09 Complaint.

Plaintiff has shown This Court undisputed and undisputable proofs of Fern Brown Caplan's conspiracy with Timothy E. Possenti
to inflict thirteen felony counts which caused injuries and damages to Plaintiff and Plaintiff's grandchildren in CCP
Philadelphia Family Court DR No. 0C0705124.
12. Fern Brown Caplan and Timothy E.
Possenti enjoy a smug confidence in knowing that their evasion of This Court's bogus summons will have no consequences as
shown to This Court in Plaintiff's February 4, 2010 filing of Timothy E. Possenti's relentless malicious acts against Plaintiff's
family including Extortion of Plaintiff's son in law, Possenti's very own client.
13. Timothy E.
Possenti, Esquire attempted to cover up his extortion and forged documents crimes by defrauding Philadelphia and Georgia divorce
courts; enlisting Possenti family friend Mayor of Norwood, George F. McCloskey, to perform bigamy marriage of Roxanne Grinage's
son-in-law, in an effort to give Possenti's client anything he wants to stop Possenti's extorted client from repeating the
November 17, 2009 video statement details of Timothy Possenti, Fern Brown Caplan, Judge Robert J. Matthews and Anne Marie
Ambrose's phony October 16, 2010 Rule To Show Cause hearing and the DHS kidnap for profit racketeering, bribery scheme that
went on that day presided over by perjury (and reasonably believed to be mentally ill) Judge Robert J. Matthews.

Timothy E. Possenti is so malicious and so immoral, he does not care that he has left Plaintiff's son in law - also a member
of Plaintiff's injured family - "holding the bag" for the felony crime of Bigamy; and that Saundra O. Sullivan who
thought she would have a "back door" fraudulent adoption claim has to deal with charges of marriage concealment
and Social Security Disability Income Fraud.
15. The household finances of Timothy
E. Possenti's client are devastated as are Possenti/Caplan victim Plaintiff's grandchildren and finances.

Organized crime Defendant Timothy E. Possenti goes on as smug as ever, his wife and three sons enjoying opportunities
for safety, enrichment education and healthcare in Delaware County outside of Possenti/Caplan Philadelphia community "stomping
grounds" where Timothy E. Possenti and Fern Brown Caplan siphon federal and state funding by traveling to CCP Philadelphia
Family Court to feed upon in vampire like fashion the finances careers health and education of middle class and working poor
Philadelphia community residents.

committees consider issues brought to them by the Supreme Court, judges, attorneys, employees of the Unified Judicial

in the federal courts and in other states for impact on Pennsylvania court procedure. Rule change proposals are
published for comment here on the Unified Judicial System's Web site, on the respective committees' pages; in the 'Pennsylvania
Bulletin' and in other national, state and local legal publications. Proposals also are distributed to interested organizations
and individuals. Some rule change proposals, however, are submitted directly to the Supreme Court without advance
publication or opportunity for the public to comment. This occurs when circumstances require prompt action, or because a
proposed rule change is technical or perfunctory in nature. The committees review all public comments. When the
review process is completed, one of two things occurs: a final draft of the rule change proposal is submitted to the Supreme
Court for consideration, or the committee drops the proposal, based on its review of public comments. The Supreme
Court may adopt, amend or reject any recommendation it receives from a procedural rules committee. The Court's orders
are published for the public's information in the same manner as committee proposals. Explanatory reports or comments
published with rule proposals provide insight into committee considerations in developing specific proposals. In addition,
explanatory notes or comments within or immediately following the texts of final rules serve as guidelines for understanding
the purpose for which rules were drafted. However, this portion of the rule is not officially adopted by the Supreme Court,
nor does it constitute part of the rule. The Committee on Rules of Evidence was created on September 8, 1998 by the
Supreme Court of Pennsylvania to advise and assist the court in prescribing general rules governing all court proceedings
in Pennsylvania's Unified Judicial System. (See Article V, § 10(c) of the Pennsylvania Constitution
and 42 Pa.C.S. § 1722.) The committee is successor to the Ad Hoc Committee on Evidence appointed by the Supreme
Court in 1994 to develop a comprehensive code of evidence for the court's consideration. After an extensive public comment
period, and subsequent revisions, the Ad Hoc Committee's final proposal was adopted by the Supreme Court on May 8, 1998
as the Pennsylvania Rules of Evidence, effective October 1, 1998.
